Article 1 – Definitions

In these conditions the following terms shall have the following meanings:

Consumer: the client who concludes an online agreement with the organisation;

Article 3 – Applicability

These General Conditions apply to any offer by Nira Craft Designer. Moreover, to any agreement concluded on-line between the Company and the consumer. Before the online agreement is concluded, the text of these General Conditions will be made available to the consumer.

Article 4 – Offer

If an offer has a limited period of validity or is made subject to terms and conditions, this will be explicitly stated in the offer. The offer contains a full and accurate description of the products offered, showing clearly which rights are applicable and which obligations are attached. The description is sufficiently detailed to allow the consumer a proper assessment of the offer. Prices are shown with taxes included. Service- and delivery fees are combined.

Article 5 – The Agreement

Subject to the approval of the provisions of paragraph 4, the agreement is concluded at the time of acceptance of the offer by the Consumer and the fulfilment of the conditions set for that purpose. If the Consumer has accepted the offer electronically, the Company will immediately confirm receipt of the acceptance of the offer electronically. When the purchase has been completed, the consumer will see an order confirmation directly on the screen. An order confirmation is also sent to the given e-mail address registered during the order process. In case the order confirmation is not received, the consumer could contact the Customer Service. The consumer has the right to dissolve the agreement as long as the receipt of this acceptance has not been confirmed.

Within legal frameworks, the Company may inform whether the Consumer can meet his payment obligations, as well as whether all facts and factors that matter for a responsible online conclusion of the agreement. On the basis of this investigation, if the Company has solid grounds not to agree, he will be entitled to refuse an order or application stating reasons or to attach special conditions to the execution.

The Company will include the following information for the product or service to the Consumer, in writing or such a manner that this can be stored by the consumer in an easily accessible manner on a sustainable information carrier: a. the contact information of the Entrepreneur where the Consumer can lodge any complaints; b. The conditions under which and the way in which the Consumer may use the right to revoke, or a clear notification on being refused the right to revoke.

Article 6 – Right to revoke on a delivery of products

The consumer can cancel the order until one weekday after purchase the order. In case of the fact that the company has already made costs for the production of the order, only restitution for a certain part will be possible. A delivered order cannot be cancelled when incomplete or incorrect delivery information is given.

Article 7 – Payment

Paypal online payment option is available to consumers with or without a Paypal account.

Bank Transfer to the company bank account.

Article 8 – Briefing, Changes and Artwork approval

After your purchase, you will receive a link to fill the briefing file and send us the logo in high resolution. We will prepare the artwork and send to you for analysis according to the deadline informed. Only one layout is made, if you want more than one option, request the “extra artwork” fee for more than one option.

In case of multiple arts purchase, the deadline will be individual for each item and according to the individual deadline informed on the website.

Once you receive the artwork, you should give us a confirmation of receipt. Please do not delay more than 3 days to confirm otherwise the deadline can extend much more, and we will not be responsible if it exceeds the deadline. While giving a feedback on what you think of the artwork created, you can:

Approve: If you happy with the layout and no adjustment is needed. The final file will be prepared and sent within 24 hours. After the approval, any extra modification will be charged.

Ask some changes: It will be necessary for the client to inform us by email, in detail of what she did not like in the artwork (such as changes to font and text, colour and images)and how she would like it to be so we can fix it. In this case be aware that to make the changes the deadline will extend FOR 3 MORE WORKING DAYS, so it is important to send us all the changes at once. The first and second adjustments are included in the price. From the third adjustment, an extra charge of €10 will be applied.

Ask a completely different layout: This never happened, but if it happens, the customer may not have specified in detail on the briefing form how she would like it. This way all the artwork will be excluded, and we will begin the creation of new artwork. The term will return to the beginning of the SERVICE CONTRACT and in the case you not satisfied with the new artwork the order will be cancelled. Check the topic “Refund Policy”.

Article 9 – Delivery

Once the artwork is approved we will close the files and send in your email in the .zip folder in other cases we will send the unzipped files. It can also be a link where you can download the files. The link will be available for only 3 days. This takes up to 2 working days to process, as some artworks are faster than others. AFTER APPROVED, NO MORE MODIFICATION WILL BE POSSIBLE.

We send the file in high resolution, in the format specified in the artwork description.

Article 10 – Refund policy

If you disapprove the artwork after the two options sent only 60% of the amount paid will be refunded to cover the designer hours.

Article 11 –  Disputes

Only Portuguese law shall apply to agreements between the Company and the Consumer to which these General Conditions relate.

Article 12 – Privacy

Nira Craft Designer handles all customer information as confidential. Nira Craft Designer does not provide customer information to third parties without the customer’s explicit consent. For more information read the Privacy Policy.

Nira Craft Designer regularly sends newsletters by email. After placing an order, the consumer could choose to receive newsletters by email. If the newsletters are no longer wanted, the consumer can always subscribe from the email database.

Article 13 – Miscellaneous

Downloading content from Nira Craft Designer website is at the risk of the consumer. The material, including images, are protected by copyright laws. All pictures on the site are owned by the company, and any commercial use of display of the pictures and plagiarism of text, without the explicit approval of Nira Craft Designer, is strictly forbidden.

Nira Craft Designer is in his right to update these conditions.
